Recently we received a question of whether employees in Ontario who take maternity and parental leave for the one year accrue their regular vacation as per their employment contract. If that were so, the inquirer wanted to know whether it was normal practice to allow those employees to take the accrued vacation right after their leave has ended (i.e., extending their time off).

On April 29, 2014, Bill 21, the Employment Standards Amendments Act (Leaves to Help Families), 2014, received royal assent and will come into force six months after assent, on October 29, 2014.

Private member’s bill would curtail unpaid internships

Opposition MPP Jonah Schein has introduced a private member’s bill to place stricter limits on unpaid internships in Ontario. Bill 170, Employment Standards Amendment Act (Greater Protection for Interns and Vulnerable Workers), 2014, doesn’t seek to eliminate unpaid internships entirely, but rather hopes to make employers more accountable and give interns (and students) more legal clout.

Politics over pragmatism? Job-protected leaves for the death and disappearance of child due to crime or a critically ill child

On December 14, 2012, the federal Helping Families in Need Act (formerly Bill C–44) received Royal Assent and provisions were proclaimed in effect on March 24, 2013 and June 9, 2013. That Act among other things, amended the Canada Labour Code to permit an employee to take a job-protected leave of absence without pay if the employee is the parent of a child who has disappeared or died and it is probable, considering the circumstances, that the child disappeared or died as a result of a crime.
