Harassment not related to gender – human rights complaint dismissed
The chair of the Alberta Human Rights Tribunal recently decided that an employee was not harassed based on the prohibited ground of gender because she could not establish a prima facie case of harassment. It turned out that there was some harassment involved, but this harassment had to do with a peculiar and historic combative relationship between the employee and her harassers.
Termination was excessive despite identical first safety violation
An employee committed a safety violation (failure to lock-out) for a second time and was terminated. The first time, he received a one-day suspension. The Ontario arbitrator found that the termination was excessive and should be substituted with a disciplinary measure amounting to a six-month suspension without pay along with a last-chance agreement.
