With employees returning to the office, many Canadian employers are considering implementing mandatory vaccination policies in their workplaces. This is giving rise to many questions, including the legality of such policies as a condition of accessing the workplace.

As the COVID-19 pandemic continues, the Ontario government has announced the extension of the 3-day COVID-19 paid leave. This extension will currently run until the end of 2021 as new risks and information are being identified in association with the delta variant of COVID-19. Employers are to ensure that they are up to date with extended COVID-19 sick days to provide to their employees.
A couple of years ago, the Workplace Safety and Insurance Appeals Tribunal ("WSIAT") statute-barred a constructive dismissal claim for chronic mental stress arising from a poisoned work environment, along with claims for aggravated, moral and punitive damages, which meant that employees would not be able to pursue such claims before the courts.
