Damages for wrongful dismissal awarded as per ‘rule of thumb’
Although the Ontario Superior Court of Justice disagreed with the employees’ “rule of thumb” proposals of one months’ pay for each year of service and a cap of 24 months, the Court awarded this to the employees anyway because it was reasonable in the circumstances of this case.
Employer not convicted when employee ignored instructions and caused accident
The Ontario Court of Justice just set aside two convictions against an employer after learning that an employee who caused a collision and injuries was only hired to clean cars, not drive them. It was clear from the evidence that the employer hired the employee to clean cars and specifically told the employee not to drive cars.
