Termination clauses: (Yet) another one bites the dust

I advise employers and employees and therefore regularly draft and review termination clauses. The issue of whether a termination clause complies with the minimum notice requirements set out in the Employment Standards Act (the “ESA”) may be the most litigated issue in employment law over the past 5 years. So employment lawyers like me pay close attention to what the courts are saying on this issue.

New parents, new responsibilities: Help for employers with post-parental leave concerns

A recent Globe and Mail article highlights the fears that new parents face as they contemplate returning to work after a parental leave. It also highlights the issues employers must address when those employees return to work. Since our employer clients often raise questions about post–leave matters, we would like to offer some helpful tips on this issue.

National Aboriginal Day: Celebrating 20 years

On June 21, the summer solstice, National Aboriginal Day is celebrated in Canada. This day of recognition and celebration was established, in cooperation with Indigenous organizations, to honour the unique heritage, diverse cultures and outstanding contributions of First Nations, Inuit and Métis peoples. While these three groups share many similarities, they each have their own distinct heritage, language, cultural practices and spiritual beliefs.
