Vicarious liability for the intentional torts of workers

It is not always clear when an organization will be liable for the intentional wrongs committed by its representatives. Recent case decisions underscore the difficulty in determining in what circumstances an organization will be held vicariously liable for the intentional wrongs of its workers as well as the challenges in trying to gauge whether a court will find that there was sufficient connection between such intentional wrong and the worker's duties.

Record human rights damage award for injury to dignity, feelings and self-respect: AB v Joe Singer Shoes Limited

The Human Rights Tribunal of Ontario has awarded a record $200,000 as a human rights damage award in the case of AB v Joe Singer Shoes Limited, where the employee suffered injury to dignity, feelings and self-respect resulting from repeated sexual assault and harassment.

There’s a tidal shift happening in human rights – Are employers ready?

The intolerance brought on by the #MeToo movement is being mirrored in Human Rights Tribunal decisions across the country as awards for damages relating to sexual harassment show an upward trend. There are also other changes brewing in human rights law, particularly in Ontario. A recent decision on age discrimination and benefit coverage may require significant amendments to employer benefit plans and resulting costs to employers.
