Qualifying for public holiday pay under the Employment Standards Act: The case of the landscape gardener

In the matter of Brock Property Maintenance Inc. v Brian Collins, heard before the Ontario Labour Relations Board, the employer filed an application for review of an Order to Pay that an Employment Standards Officer issued against it regarding an employee’s public holiday pay.

Employee was terminated, not transferred as suggested by employer

In the matter of Serpa BMW v John Hare, heard before the Ontario Labour Relations Board, the employer filed an application for review of an Order to Pay that an Employment Standards Officer issued against it regarding an employee’s termination and severance pay.

Employee’s suspension deemed too severe by Court

In the matter of Canada (Attorney General) v. Gatien, the Federal Court of Appeal concluded that the Federal Court erred in applying the right standards of review regarding an employee’s suspension.
