Bill S-228, "An Act to amend the Food and Drugs Act (prohibiting food and beverage marketing directed at children)", has been undergoing legislative review since late 2016. It has been the subject of much debate and is still awaiting Royal Assent.
From the Instagram model advertising gifted products to the geek blogger paid to review video games, influencer advertising is now everywhere. Digital marketing is rapidly evolving (the world even saw its first CGI influencer earlier this year), and regulators are adapting accordingly.
With the legalization of recreational cannabis approaching, regulations are being set to control the advertising and promotion of the product. Health Canada has indicated that it will not be pre-publishing the regulations for consultation. At this time, it does not appear that the proposed regulations will supplement the advertising provisions of the Cannabis Act, except in relation to packaging and labelling.
