Disability, employment and the new veterans charter

The relationship between disability and employment is slowly changing, and as much as we are mindful of developing trends in policy and law, we still have the obligation to recognize and respect disability from a cross sector perspective, including individuals who have served in the Canadian Forces, acquiring an injury as a result.

Accessibility for Ontarians with Disabilities Act (AODA) aims to make the province of Ontario fully accessible for people with disabilities by 2025. Since the AODA became law in 2005, Ontario has established accessibility standards for customer service, information and communications, employment, transportation, and the built environment: design of public spaces. OHRT rules the “flu” is not a “disability” attracting the protection of the Human Rights Code

Rule of lawAs an employment law practitioner, it is refreshing to see any court and/or administrative tribunal release a decision that makes “common sense” (as well as legal sense). Recently, the Ontario Human Rights Tribunal had to determine if the common flu and strep throat constituted disabilities under the Human Rights Code .
